Privacy Policy & Data Processing Terms

This Privacy Policy and Data Processing Terms document (“Policy”) explains how Understandly LLC (“Understandly,” “Company,” “we,” “us,” or “our”) collects, uses, protects, and processes information in connection with the Understandly platform, applications, website, AI tools, and related services (collectively, the “Service”).

This Policy forms part of and is incorporated into the Understandly Terms of Service.

1. Introduction

Understandly provides an AI-guided learning and testing platform designed for homeschool families, parents, students, co-operatives, and educator groups. Protecting student and family privacy is fundamental to our mission. This Policy explains how we collect, use, disclose, and safeguard information when the Service is used for educational purposes.

2. Student Privacy and Legal Framework

When the Service is used for educational purposes by a parent, guardian, co-operative, or educator (collectively, an “Educational Organizer”), we may receive or process personal information directly related to students (“Student Data”). Understandly processes Student Data as a service provider and data processor acting on behalf of the Educational Organizer and uses Student Data solely to provide the Service and for no unrelated commercial purpose. The Service is designed to support compliance with applicable student privacy laws, including the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), the Protection of Pupil Rights Amendment (PPRA), and applicable U.S. state student privacy laws. Educational Organizers are responsible for obtaining any required parental or guardian consents.

3. Children Under 13

The Service may be used by children under the age of thirteen only under the direction of a parent, guardian, or Educational Organizer. We rely on the Educational Organizer to provide appropriate consent for collection of a child's information for educational use. Student information is used only to provide the Service and is not used for advertising. Parents and guardians have the right to review, access, and request deletion of their child's personal information, and to refuse further collection or use of such information. Understandly does not knowingly collect personal information from children under 13 without verifiable parental consent. Parents or guardians may contact us at support@understandly.com to exercise these rights or request assistance.

4. Sources of Information

We collect information from parents, guardians, students, educators, co-operative leaders, and website visitors. Information may be obtained directly from users when accounts are created, from student activity within the platform, from Educational Organizers who create student accounts, and automatically from devices and system logs.

5. Information We Collect

We limit data collection to what is necessary to provide the Service. Information collected may include:

  • Account information such as names, email addresses, usernames, login credentials, and account identifiers.
  • Student Data such as student names or identifiers, grade level, assignment responses, learning progress, and performance records; educational content including assignments, uploaded curriculum materials, and student work.
  • AI interaction data consisting of prompts entered into AI tools and system responses within the learning environment.
  • Usage and log data such as device type, browser type, IP address, pages visited, time spent, and platform interactions.

Users are prohibited from uploading sensitive personal information such as Social Security numbers, financial account numbers, or medical records.

6. How Information Is Used

Information is used to provide and operate the Service, deliver AI-guided learning support, maintain accounts and learning records, provide customer support, improve platform performance and functionality, ensure system security, and comply with legal obligations. We do not use Student Data for advertising or marketing purposes.

7. AI System Data Use

AI tools within the Service provide contextual educational assistance. AI interaction data may be analyzed in aggregated form to improve system performance and functionality. Understandly does not use identifiable student personal data to train general-purpose AI models.

8. Data Sharing

We do not sell personal information or Student Data. We may share information with trusted service providers that assist in operating the Service, such as cloud hosting providers or technical support vendors. These providers are contractually required to protect data and use it only to support the Service. Information may also be disclosed where required by law.

9. Access to Student Content

Student work and learning records are accessible only to the student, the parent or guardian, and the Educational Organizer managing the account. Understandly cannot prevent all forms of external sharing, such as screenshots, and Educational Organizers are responsible for managing user access and permissions.

10. Cookies and Analytics

We use cookies and similar technologies for session management, performance monitoring, and service improvement. We do not use third-party advertising cookies.

11. Data Retention

Personal information and Student Data are retained only as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Data may be deleted or de-identified after account inactivity or upon verified request.

12. Data Deletion

Parents or Educational Organizers may request deletion of Student Data. Upon verified request, we will delete or de-identify such data within a reasonable timeframe, except where retention is required by law.

13. Security

We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction. However, no system can guarantee absolute security. In the event of a confirmed data breach affecting personal information, we will notify affected users as required by applicable law.

14. Restrictions on Data Use

Understandly will not sell Student Data, use Student Data for targeted advertising, build non-educational profiles of students, or use data for unrelated commercial purposes.

15. Data Processing Role

Educational Organizers act as data controllers with respect to Student Data. Understandly acts as a data processor or service provider and processes Student Data only to provide the Service in accordance with our agreements.

16. Changes to This Policy

We may update this Policy to reflect changes in practices or applicable law. Continued use of the Service after updates constitutes acceptance of the revised Policy.
